Privacy Notices

How we collect, use and protect your personal data, under the Mexican Federal Law on Protection of Personal Data Held by Private Parties.

Privacy Notice for Candidates and Employees

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the "Law" or the "FLPPDPP"), the Regulation of the Law (the "Regulation"), and the Privacy Notice Guidelines (the "Guidelines"), among other applicable provisions in force in the United Mexican States, we hereby inform you, as the "Owner" of Personal Data, of the following:

I. Data Controller responsible for the processing of your Personal Data.

Grupo Telat, which is comprised of the following legal entities: 1) Teleservicios Latinoamericanos S.A. de C.V.; 2) Telat México, S.A. de C.V.; and 3) Teltecnia, S.A. de C.V. (hereinafter jointly or individually referred to as "Telat" or the "Controller"), located at: Avenida Monterrey 149, Colonia Roma Norte, Alcaldía Cuauhtémoc, C.P. 06700, Mexico City, Mexico, in its capacity as the "Controller" of the processing of your Personal Data, hereby provides you with this Privacy Notice (hereinafter the "Notice").

II. Personal Data Collected and Primary Purposes.

Telat will collect and process the following personal data as indicated in each case, including sensitive and financial data, from employees and potential employees. We take special care with your financial data and, especially, with your sensitive data, as they may include biometric, medical, or psychological information. Regarding this data, we emphasize that it is collected in accordance with and in compliance with the provisions of Articles 7 and 8 of the FLPPDPP.

Telat may collect your Personal Data in various ways: 1) when you, as an individual, provide us with Personal Data directly; 2) when you visit our website, our TELAT APP, or use our online services; and 3) when Telat obtains information through other sources permitted by law.

The Personal Data we collect and the primary purposes are as follows:

Personal Data Collected: Primary Purposes:
  • 1) Contact Information: Full name, address, place of origin, telephone, and personal email.
  • 2) Valid official identification.
  • 3) Date and place of birth.
  • 4) Gender and marital status.
  • 5) Academic and employment information.
  • 6) Employment and/or personal references.
  • 7) For foreigners: Immigration status in the country, country of origin, and length of residency.
  • 8) Sensitive Personal Data: medical information, results of psychometric and socioeconomic studies.
  • 9) Financial or Asset-related Personal Data: previous and/or current salary.
  • 1) To identify and contact you.
  • 2) Compile your file as a candidate for employment.
  • 3) Conduct the selection process correctly as a potential Telat employee.
  • 4) Verify the absence of independence or conflict of interest issues with other employees or company entities within the group.
  • 5) Comply with applicable regulations.
  • 6) Verify and confirm your identity and request references.
  • 7) For foreigners: validate your immigration status in the country and check if you are authorized to work in Mexican territory.
  • 8) Provide access to systems and/or applications for the selection process as a potential Telat employee.
Telat’s Employees
  • 1) Contact Information: Full name, address, phone number, place of origin, and personal email.
  • 2) Academic and employment information.
  • 3) Valid official identifications.
  • 4) CURP (Unique Population Registry Code in Mexico).
  • 5) Gender and marital status.
  • 6) RFC (Taxpayer Registry Number) and Tax Regime.
  • 7) Social security number.
  • 8) Employment and/or personal references.
  • 9) Personal photograph.
  • 10) For foreigners: immigration documents such as FM2 or FM3.
  • 11) Sensitive Personal Data: biometric data, handwritten signature, medical information including illnesses and history, results of psychometric and socioeconomic studies.
  • 12) Financial or Asset-related Personal Data: Bank statement cover page, CLABE (standardized banking account number) and/or card number; AFORE account number, applicable deductions from INFONAVIT and FONACOT credits, previous and/or current salary.
  • 1) Identify and contact the individual.
  • 2) Compile their file as a Telat Collaborator and register them in our systems.
  • 3) Verify the absence of independence or conflict of interest issues with other employees or companies within our group.
  • 4) Provide the necessary equipment, tools, and information for them to fulfill the services outlined in their employment contract with Telat.
  • 5) Conduct the selection process correctly for potential job promotions within Telat.
  • 6) Comply with applicable regulations.
  • 7) Register and deregister the employee with the Mexican Social Security Institute and INFONAVIT or FONACOT.
  • 8) Payment of worker-employer contributions and deductions for INFONAVIT and FONACOT credits.
  • 9) Set up a bank account for payroll payment.
  • 10) Process payroll payments.
  • 11) Provide access to facilities, attendance control systems, and applications needed to perform the contracted activities.
  • 12) Offer medical attention through Telat's nursing staff.
  • 13) Handle justifications for absences, permissions, or special requests.
  • 14) Verify and confirm their identity and request references.
  • 15) Provide training courses.
  • 16) Offer additional corporate benefits as a Collaborator (meal vouchers, transportation, and medical expense plan/insurance).

III. Secondary Purposes.

Telat will use your Personal Data to fulfill secondary purposes, such as: (i) marketing, advertising, or commercial prospecting purposes regarding services we offer, either our own or those of third parties; (ii) conducting statistics; and (iii) creating materials for internal and external campaigns. In this specific case, this will only apply to Telat Collaborators. In addition to your consent in this Privacy Notice, you will be provided with an authorization letter for the use of your image to obtain your express and written consent prior to such processing.

If you do not wish for your personal data to be processed for these secondary purposes, you can inform us at this moment by specifying the secondary purposes for which you wish to express your refusal to the processing of your data, whether for one or all of the secondary purposes. You can do this by sending a request to the email address: dataprotection@telat-group.com, where you must indicate the following: "I do not consent to my personal data being used for the following secondary purposes," specifying to which of them you are refusing.

Your rights are safeguarded to exercise the withdrawal of consent, or your right to object, in case you do not express your refusal for the processing of your personal data regarding the secondary purposes at this moment.

IV. Data Retention Period.

Telat will safeguard and process the Personal Data of its Candidates and/or Workers for the retention periods allowed by the Law solely for the fulfillment of the purposes that justified the processing, never exceeding these periods, except in cases where it is required by legal provisions or by the competent Authority regarding the specific matter, such as in administrative, labor, accounting, fiscal, criminal, and commercial matters.

Sensitive Personal Data will be safeguarded for the shortest time required for the purposes stated within this Notice, fully in compliance with Article 12 of the LFPDPPP.

Finally, once the purposes of the processing have been fulfilled, and in the absence of a legal or regulatory provision stating otherwise, Telat will proceed to cancel the Personal Data in its possession after blocking them, for their subsequent deletion in full compliance with applicable legal provisions.

V. Video Surveillance Cameras for Security.

Telat has a video camera system that operates 24 hours a day, every day of the year, in all areas of its offices, workplaces, and auxiliary facilities (excluding restrooms), solely to ensure the safety of our employees, visitors, and premises. Additionally, visible notices are displayed in our offices for our employees and visitors informing them about the aforementioned.

At no time will Telat share such recordings with any individual or entity, except in cases where a competent Authority duly and in writing requests it with proper justification.

VI. Transfer of Personal Data.

Telat may transmit your Personal Data upon request by the competent authority or in any of the other cases established in Articles 9 and 36 of the LFPDPP, for which the consent of the data subject is not required in accordance with the current regulations in force.

Telat informs you that your Personal Data may be processed within and outside the country by national or foreign subsidiary companies and/or may be sent to companies acting as Processors on behalf of Telat to process them in accordance with the purposes described in this Notice or for any other use authorized by law. These companies must commit to Telat to use such shared Personal Data only for the fulfillment of the agreed purposes, and not to sell or disclose them, except in cases authorized by law, with prior authorization from Telat.

Lastly, concerning the above, it is important to note that Telat transfers Personal Data of its Workers only to:

  • Banking Institutions: Data such as Name, CURP, RFC, Address, Marital status, and gender will be shared solely for the purpose of opening their payroll account, in which Telat will make payments related to payroll and any other entitlement.
  • Insurance Institutions or Insurers: Data such as Name, CURP, RFC, Address, Marital status, and gender will be shared solely for the purpose of providing minor and/or major medical expense insurance depending on the case.
  • Competent Authorities: Individuals, entities, or authorities for whom the communication of their personal data is mandatory in accordance with the provisions of laws or orders of the authorities.
  • Telat's Commercial Clients: In this case, data will only be shared with Individuals or Legal Entities that have a commercial relationship with Telat as documented in a Contract. This information transfer will always be based on the terms of the Legal Instrument in place with full compliance with the provisions outlined in this Privacy Notice.

Telat does not transfer personal data from our candidates to any entity.

VII. Access, Rectification, Cancellation and Objection Rights (ARCO Rights)

You have the right to (i) know what Personal Data we have about you, how we use it, and the conditions of use (Access); (ii) request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); (iii) request the deletion of your Personal Data from our records or databases when you believe it is not being used appropriately (Cancellation); and (iv) object to the use of your Personal Data for primary or secondary purposes (Objection). These rights are known as ARCO rights.

VIII. Exercising ARCO Rights and Revocation of Consent.

Telat provides you with the following procedure, means, and requirements for exercising your ARCO rights and revoking consent for the processing of your personal data:

To submit and address a request to exercise ARCO rights or revoke consent for the processing of your personal data with Telat, the Data Subject must submit a request via a form, which can be found in the "Request for Exercise of ARCO Rights/Revocation of Consent" tab located at the top of the Privacy Notice, which you can access at the following link: https://telat-group.com/aviso-de-privacidad, or alternatively, by sending a request via email addressed to the Privacy Officer at the email address: protecciondedatospersonales@telat-group.com, including the following information:

  • In the email, specify whether it is to exercise your ARCO rights or revoke consent.
  • The full name of the Data Subject.
  • Copy of documents proving the identity of the Data Subject (valid official identification / valid passport) on both sides.
  • If the Data Subject is represented by a legal representative: the latter must also present, through the same means, the documents proving the legal representation (e.g., a simple power of attorney signed by the Data Subject, the attorney, and two witnesses, accompanied by a copy of the identifications of the attorney and witnesses).
  • Clear and precise description of the Personal Data for which any of the ARCO rights are to be exercised.
  • Any other element or document that facilitates the location of the Personal Data
  • Indicate the modifications to be made and/or the limitations on the use of the Personal Data and provide the documentation supporting the request.

Requests for the exercise of ARCO rights under this section will be addressed within a maximum period of 20 (twenty) business days from the date the request was received. If the request is approved, it will be executed within the following 15 (fifteen) business days from the date the Responsible Party communicates the response. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances justify it, based on the provisions of article 31 of the LFPDPPP.

If the information provided in the request is incorrect or insufficient, or if the necessary documents to prove identity or legal representation are not provided, Telat, within 5 (five) business days of receiving the request, will request that the deficiencies be corrected to proceed with the request. This request must be addressed by the Data Subject within 10 (ten) business days after receiving it; otherwise, the request will be considered not submitted, and if the Data Subject wishes to exercise their rights again, a new request must be submitted. If the Data Subject complies with the information request, the period for the Responsible Party to respond to the request will start the day after the Data Subject has complied with the request.

If Telat does not respond to your request after the specified legal and regulatory deadline, you may initiate the ARCO rights protection procedure with the Anti-Corruption and Good Governance Secretariat, located at Insurgentes Sur 1735, Colonia Guadalupe Inn, C.P. 01020, Mexico City, according to the requirements that will be informed by the Secretariat in due time. IX. Use of Cookies.

We inform you that on our website, we use cookies and other technologies through which we can monitor your behavior as an Internet user, provide you with better service and user experience while browsing our site, and offer new services based on your preferences. These cookies are used to gather information about how visitors use our website, such as distinguishing one user from another, collecting the number of visitors to the site, interactions on the site, and the geographic location of visitors. X. Security and Control Measures.

For the security of our Employees and Candidates, Telat asserts that it has the broadest and strictest administrative, technical, and physical security measures derived from the best international practices in terms of quality and security to protect Personal Data against any damage, loss, alteration, destruction, unauthorized use, access, or processing. We also require our business partners and allies, including companies that act as controllers, subsidiaries, or affiliates of Telat, to comply with these security measures.

XI. Modifications to the Privacy Notice

Telat reserves the right to make modifications to this Notice at any time, whether to update it due to new legal requirements, our own needs for the products or services we offer, changes in our privacy practices, policy changes, changes in our business model, or changes in applicable legal provisions. In the event of any substantial change to this Privacy Notice, it will be communicated through any of the following means:

  • To our Employees: it will be communicated via email and notification on the company's Intranet.
  • To others: please continue to check our website, www.telat-group.com.

Telat will not be responsible if you do not receive notification of the change to this Privacy Notice due to any issues with your email account, data transmission over the Internet, or for any cause not attributable to Telat. For your safety and information, we highly recommend that you periodically review the content of this Privacy Notice, or send us any requests for information or clarifications to our email address: protecciondedatospersonales@telat-group.com.

XII. Consent.

For the purposes of the Law and particularly in its Articles 7 and 16, you hereby declare: (i) That you have read, understood, and agreed to the terms set forth in this Privacy Notice; (ii) That you give your express consent for your Personal Data, including those of a Financial or Patrimonial and Sensitive nature, to be collected and processed in accordance with the provisions of this Privacy Notice in compliance with Articles 7 and 8 of the LFPDPPP; and (iii) To give your consent for the transfer of Personal Data, solely to the entities listed in Section VI

  • 2) Compile the Customer file and properly register it.
  • 3) Verify the identity being presented.
  • 4) Ensure there are no conflicts of independence or interests with any other of our clients.
  • 5) Provide the services contracted with us and fulfill the obligations agreed upon.
  • 6) Process payments.
  • 7) Comply with applicable regulations.
  • 8) Collect the necessary data to carry out the billing process.
  • 9) If necessary, carry out collection efforts.
  • 10) Send information related to our services.

III. Secondary Purposes.

Telat will use your Personal Data for the purpose of fulfilling secondary purposes, such as: (i) marketing, advertising, or commercial prospecting regarding the services we offer, whether our own or those of third parties; and (ii) conducting service surveys to assess and improve the quality of the products and services we provide.

If you do not wish for your personal data to be processed for these secondary purposes, you can notify us of this at this time, specifying the secondary purposes for which you wish to express your refusal to the processing of your data, whether for one or all secondary purposes. You can do this by sending a request via email to: protecciondedatospersonales@telat-group.com, where you should indicate the following: "I do not consent to my personal data being used for the following secondary purposes," specifying which of them you are refusing.

Your rights are safeguarded to exercise the revocation of consent, or your Right of Objection, in case you do not express your refusal to the processing of your personal data for the secondary purposes at this time.

These companies must commit to Telat to use such shared Personal Data only for the fulfillment of the agreed purposes, as well as not to sell or disclose them, except in those cases authorized by the Law, with prior authorization from Telat.

Apart from the above, Telat does not carry out any other type of transfer of Personal Data of our clients.

VII. Access, Rectification, Cancellation and objection Rights (ARCO Rights)

Privacy Notice for Suppliers

In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the "Law" or the "FLPPDPP"), the Regulation of the Law (the "Regulation"), and the Privacy Notice Guidelines (the "Guidelines"), among other applicable provisions in force in the United Mexican States, we hereby inform you, as the "Owner" of Personal Data, of the following:

I. Data Controller for the processing your Personal Data.

Grupo Telat, which is comprised of the following legal entities: 1) Teleservicios Latinoamericanos S.A. de C.V.; 2) Telat México, S.A. de C.V.; and 3) Teltecnia, S.A. de C.V. (hereinafter jointly or individually referred to as "Telat" or the "Controller"), located at: Avenida Monterrey 149, Colonia Roma Norte, Alcaldía Cuauhtémoc, C.P. 06700, Mexico City, Mexico, in its capacity as the "Controller" of the processing of your Personal Data, hereby provides you with this Privacy Notice (hereinafter the "Notice").

II. Personal Data Collected and Primary Purposes.

Telat will collect and process the following personal data as indicated in each case, including sensitive and financial data, from employees and potential employees. We take special care with your financial data and, especially, with your sensitive data, as they may include biometric, medical, or psychological information. Regarding this data, we emphasize that it is collected in accordance with and in compliance with the provisions of Articles 7 and 8 of the FLPPDPP.

Telat may collect your Personal Data in various ways: 1) when you, as an individual, provide us with Personal Data directly; 2) when you visit our website, our TELAT APP, or use our online services; and 3) when Telat obtains information through other sources permitted by law.

  • 3) Unique Population Registry Code in Mexico.
  • 4) Phone number.
  • 5) Address.
  • 6) RFC (Taxpayer Registry Number) and Tax Regime.
  • 7) Opinión del cumplimiento de Obligaciones Fiscales.
  • 8) Financial or Asset-related Personal Data: Bank statement cover page, CLABE (standardized banking account number) and/or card number.
  • 1) Identify and contact the individual.
  • 2) Compile the Customer file and properly register it.
  • 3) Verify the identity being presented.
  • 4) Ensure there are no conflicts of independence or interests with any other of our clients.
  • 5) Provide the services contracted with us and fulfill the obligations agreed upon.
  • 6) Process payments.
  • 7) Comply with applicable regulations.
  • 8) Collect the necessary data to carry out the billing process.
  • 9) If necessary, carry out collection efforts.
  • 10) Send information related to our services.

III. Secondary Purposes.

Telat will use your Personal Data for the purpose of fulfilling secondary purposes, such as: (i) marketing, advertising, or commercial prospecting regarding the services we offer, whether our own or those of third parties; and (ii) conducting service surveys to assess and improve the quality of the products and services we provide.

If you do not wish for your personal data to be processed for these secondary purposes, you can notify us of this at this time, specifying the secondary purposes for which you wish to express your refusal to the processing of your data, whether for one or all secondary purposes. You can do this by sending a request via email to: protecciondedatospersonales@telat-group.com, where you should indicate the following: "I do not consent to my personal data being used for the following secondary purposes," specifying which of them you are refusing.

Your rights are safeguarded to exercise the revocation of consent, or your Right of Objection, in case you do not express your refusal to the processing of your personal data for the secondary purposes at this time.

IV. Data Retention Period.

Telat will safeguard and process the Personal Data of its Candidates and/or Workers for the retention periods allowed by the Law solely for the fulfillment of the purposes that justified the processing, never exceeding these periods, except in cases where it is required by legal provisions or by the competent Authority regarding the specific matter, such as in administrative, labor, accounting, fiscal, criminal, and commercial matters.

Sensitive Personal Data will be safeguarded for the shortest time required for the purposes stated within this Notice, fully in compliance with Article 12 of the LFPDPPP.

Finally, once the purposes of the processing have been fulfilled, and in the absence of a legal or regulatory provision stating otherwise, Telat will proceed to cancel the Personal Data in its possession after blocking them, for their subsequent deletion in full compliance with applicable legal provisions.

V. Video Surveillance Cameras for Security .

Telat has a video camera system that operates 24 hours a day, every day of the year, in all areas of its offices, workplaces, and auxiliary facilities (excluding restrooms), solely to ensure the safety of our employees, visitors, and premises. Additionally, visible notices are displayed in our offices for our employees and visitors informing them about the aforementioned. At no time will Telat share such recordings with any individual or entity, except in cases where a competent Authority duly and in writing requests it with proper justification.

VI. Transfer of Personal Data.

Telat may transfer your Personal Data upon request of the competent authority or in any other of the cases established in Articles 9 and 36 of the LFPDPP, for which the consent of the Holder of such personal data is not required in accordance with the Law and its Regulations.

In addition, Telat informs you that your Personal Data may be processed within and outside the country, by national or foreign affiliated companies and/or may be sent to companies acting as processors on behalf of Telat to process them in accordance with the purposes described in this Privacy Notice or for any other use authorized by the Law.

These companies must commit to Telat to use such shared Personal Data only for the fulfillment of the agreed purposes, as well as not to sell or disclose them, except in those cases authorized by the Law, with prior authorization from Telat.

Apart from the above, Telat does not carry out any other type of transfer of Personal Data of our clients.

VII. Access, Rectification, Cancellation and Objection Rights (ARCO Rights)

You have the right to (i) know what Personal Data we have about you, how we use it, and the conditions of use (Access); (ii) request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); (iii) request the deletion of your Personal Data from our records or databases when you believe it is not being used appropriately (Cancellation); and (iv) object to the use of your Personal Data for primary or secondary purposes (Objection). These rights are known as ARCO rights.

VIII. Exercising ARCO Rights and Revocation of Consent.

Telat provides you with the following procedure, means, and requirements for exercising your ARCO rights and revoking consent for the processing of your personal data:

To submit and address a request to exercise ARCO rights or revoke consent for the processing of your personal data with Telat, the Data Subject must submit a request via a form, which can be found in the "Request for Exercise of ARCO Rights/Revocation of Consent" tab located at the top of the Privacy Notice, which you can access at the following link: https://telat-group.com/aviso-de-privacidad, or alternatively, by sending a request via email addressed to the Privacy Officer at the email address: protecciondedatospersonales@telat-group.com, including the following information:

  • In the email, specify whether it is to exercise your ARCO rights or revoke consent.
  • The full name of the Data Subject.
  • Copy of documents proving the identity of the Data Subject (valid official identification / valid passport) on both sides.
  • If the Data Subject is represented by a legal representative: the latter must also present, through the same means, the documents proving the legal representation (e.g., a simple power of attorney signed by the Data Subject, the attorney, and two witnesses, accompanied by a copy of the identifications of the attorney and witnesses).
  • Clear and precise description of the Personal Data for which any of the ARCO rights are to be exercised.
  • Any other element or document that facilitates the location of the Personal Data.
  • Indicate the modifications to be made and/or the limitations on the use of the Personal Data and provide the documentation supporting the request.

Requests for the exercise of ARCO rights under this section will be addressed within a maximum period of 20 (twenty) business days from the date the request was received. If the request is approved, it will be executed within the following 15 (fifteen) business days from the date the Responsible Party communicates the response. The aforementioned deadlines may be extended once for an equal period, provided that the circumstances justify it, based on the provisions of article 31 of the LFPDPPP.

If the information provided in the request is incorrect or insufficient, or if the necessary documents to prove identity or legal representation are not provided, Telat, within 5 (five) business days of receiving the request, will request that the deficiencies be corrected to proceed with the request. This request must be addressed by the Data Subject within 10 (ten) business days after receiving it; otherwise, the request will be considered not submitted, and if the Data Subject wishes to exercise their rights again, a new request must be submitted. If the Data Subject complies with the information request, the period for the Responsible Party to respond to the request will start the day after the Data Subject has complied with the request.

If Telat does not respond to your request after the specified legal and regulatory deadline, you may initiate the ARCO rights protection procedure with the Anti-Corruption and Good Governance Secretariat, located at Insurgentes Sur 1735, Colonia Guadalupe Inn, C.P. 01020, Mexico City, according to the requirements that will be informed by the Secretariat in due time. We also require our business partners and allies, including companies that act as controllers, subsidiaries, or affiliates of Telat, to comply with these security measures

Telat reserves the right to make modifications to this Privacy Notice at any time, whether due to updates resulting from new legal requirements, our own needs for the products or services we offer, changes in our privacy practices, policies, business model, or other reasons
